No Guarantee of Document Issuance or Timely Responses from Issuing Authorities

Passport Health Passports and Visas will undertake commercially reasonable efforts to help you obtain the travel visa, passport, and/or other such documents that you determine, in consultation with us or otherwise, are required for your international trip and which you specify from amongst our offered services when requesting our assistance. Passport Health Passports and Visas endeavors to provide complete and current information regarding travel document requirements and associated application forms, fees, and processing times; however, these documents and fees, and the associated informational requirements and related protocols are subject to change frequently, sometimes with limited or no notice; accordingly, we cannot guarantee that the information and instructions we provide will be correct or effective in all instances. In all cases, the government agency issuing the desired visa, passport or other travel documents (the “issuing authority”) will make, in its own discretion and on its own timetable, in response to information and applications submitted, the final determination as to the type of travel documents to be issued, how quickly they will be issued, for what extent or duration of use they will be issued, and whether they will be issued at all. Issuing authorities may ask for additional information or documentation at any time, and Passport Health Passports and Visas will reasonably assist you in relaying your responses to such requests, where appropriate, in which case additional fees may apply depending on the extent and nature of such follow-up requests. At your request, in some circumstances, we may be able to work with you and the issuing authority to understand and potentially remedy an issuing authority’s decision not to issue the travel documents you have requested; additional fees may apply in this circumstance as well. The issuing authority may delay the processing of, or reject, any visa, passport or other travel document application for any reason and may not provide a reason to you or Passport Health Passports and Visas for their action or inaction. For the avoidance of doubt: Passport Health Passports and Visas does not issue visas, passports or other travel documents. We cannot and do not make any guarantee that the relevant issuing authorities as to any desired or necessary travel documents will in fact issue such documents, or on what timetable they may do so, nor can we make any assurance as to the purpose, validity or number of entries permitted by any travel documents actually issued. You are responsible for ensuring the accuracy, truth and correctness of the information and documents you provide to us and to any issuing authority in connection with the applications for any travel documents you seek.

Fees

Passport Health Passports and Visas’ service fees are our fees for providing limited logistical support toward helping you obtain the issuance of the travel documents you request. These fees are non-refundable, even if your request for services is terminated prior to fulfillment, however fees collected in advance for remittance to the issuing authority may be refunded if your service request is cancelled prior to such fees being paid – or becoming due and payable – to the issuing authority. Our service fees are in addition to (and do not themselves cover or include), any consular, embassy or other third-party administrative fees or charges imposed by issuing authorities or their designees in connection with the applications you submit and services or travel documents you request. Passport Health Passports and Visas’ service fees must be paid regardless of whether the requested travel documents are issued (or are timely or correctly issued) by the issuing authority. Passport Health Passports and Visas’ Service fees (as well as some consular, embassy or third-party administrative fees) vary according to various factors including the number of business processing days available to procure the requested services/documents, and rush surcharges or additional handling fees may apply.

All fees paid to an issuing authority by Passport Health Passports and Visas on your behalf are non-refundable unless actually refunded and returned to us by the issuing authority. Payment for Passport Health Passports and Visas service fees and all anticipated fees and charges of issuing authorities are due at the time you place your order for services.

Document Inspection

It is your responsibility to verify that all the travel documents you have applied for and require for your trip, have been obtained, that the visas for each country you intend to visit are valid for the nature of, and the entry and exit dates of, your visit, that your personal details are reflected accurately, and that your passport is valid for at least six months beyond the completion of your trip.

No Assurance of Entry

Passport Health Passports and Visas recommends that all travelers secure a visa prior to departure and do not attempt to obtain one “on arrival.” Please note, however, that a traveler may be denied entry into a foreign destination even if he or she has obtained a seemingly valid and proper visa, due to the fact that the local immigration officials in the destination country make the final entry decision.

No Liability

Passport Health Passports and Visas provides its services in the nature of logistical assistance, only, and does not represent, warrant or guarantee the results of any services, or the success of any applications with which it assists. Passport Health Passports and Visas will not be liable under any circumstance to compensate you for any loss, cost, expense, inconvenience or damage arising from any unsuccessful application attempts, lack of timely handling or results of any application, loss of materials, or otherwise. Without limiting the generality of the foregoing, Passport Health Passports and Visas will not be responsible for any loss, cost, expense, inconvenience or damage resulting from any loss or delay of travel documents due to a fault in performance by any third party including without limitation any delivery company such as FedEx, UPS, DHL/Airborne, USPS, or local delivery services. By submitting information and/or documents to us, or utilizing or requesting the services of Passport Health Passports and Visas, you agree to all of the foregoing and agree that Passport Health Passports and Visas will not under any circumstances be responsible for any loss, damage, or delay in the return of travel documents or application-related materials by any issuing authority or designee, nor will it be liable for the failure of the issuing authority to return or issue requested documents on your desired timetable, or at all. You are advised to consider retaining copies of any original materials you provide to us or to issuing authorities, as appropriate. By submitting an order to Passport Health Passports and Visas, you agree to all the terms and conditions set forth herein. “Passport Health Passports and Visas” is a service of Passport Health, LLC, and/or its affiliated entities, and all references thereto herein shall be understood to refer to said entity and such affiliates.
